A family gathering turned deadly in Albuquerque after an argument over dinner led to a shooting and a man on the run.

Here's what may have happened.

The suspect is identified as 22-year-old Ervin Joaquin Gutierrez. On the afternoon of August 27, Gutierrez arrived at an apartment to visit with his cousin Nathaniel Cavazos and another relative. The group went out to buy groceries before returning home to cook green enchiladas and drink alcohol. Authorities allege that an argument over the spice level of the enchiladas escalated into a physical fistfight. During the altercation, Gutierrez allegedly shot Cavazos in the back. Gutierrez then fled the scene, leaving the victim in a pool of blood. Police arrived to find Cavazos dead and later spoke with Gutierrez, who reportedly asked if his cousin was really dead. Gutierrez allegedly told officers he did not want to kill Cavazos but feared for his own life. The suspect was arrested by Albuquerque police on Friday evening. He is formally charged with murder. The case is being handled by the Albuquerque Police Department. Gutierrez was booked into the Metropolitan Detention Center shortly after midnight on Saturday.
